Why Choose Family Mediation?
Impartial
Our mediators remain impartial at all times, facilitating discussions without taking sides or making decisions for you.
Confidentiality
All mediation sessions are private, encouraging open and honest communication. Mediators must not discuss the mediation or correspond with any participant’s legal advisor without consent of each participant. Limited exceptions to confidentiality are disclosures of: significant harm to children or adults, Proceeds of Crime Act and/or money laundering regulations. If you go to court at a later stage the content of the discussions at mediation is confidential and not disclosed to the court.
Voluntary Participation
Participation in mediation is voluntary at all times and participants and the mediator are always free to withdraw. Mediation is a collaborative process that all parties agree to, fostering a cooperative environment.
Self-determined with Focus on the Future
Mediators must remain neutral as to the outcome of a mediation at all times. We do not advise but provide information, for example of possible courses of action, their legal or other implications, and assist you to explore them. We are trained to help you develop your own solutions that will work for both of you moving forward with a focus on the future .
Cost-Effective
Mediation is typically less expensive than going to court, saving you both time and money. We will assess your eligibility for Legal Aid. We are authorised to access the Ministry of Justice’s Family Mediation Voucher Scheme. This provides £500 per family towards mediation costs in cases involving children, independent of your income, but excludes the initial Mediation Information and Assessment Meeting (MIAM). If one person qualifies for Legal Aid, the MIAM and first joint mediation session will be free for the other party too. If you are not eligible for Legal Aid, the fee at Kippax Mediation for an online MIAM is £95 pp (with no VAT to add on). If we move forward with an Agreement to Mediate, the number of sessions you need to address your issues vary with each case and complexity. We will discuss mediation session fees with you before we begin, so you can decide ahead on the right package for you.
Time-Saving
Resolve issues faster than the lengthy court process, allowing you to move forward with your life.
Free Mediation
We recognise that some families have particular financial challenges but do not qualify for the limited Legal Aid available. At Kippax Mediation, we are committed to offering 2-3 selected mediation cases pro-bono (free of charge) each month.
Child-Centred Approach
At all times mediators must have special regard to the welfare of any children of the family. We encourage you to focus on the needs and interests of the children and to consider their wishes and feelings. Our considerable expertise in family matters is there to support you.
Legal Context and Process
Understanding Family Mediation in England
Legal aid may be available for those who qualify, covering the cost of mediation sessions. The mediation process typically involves several sessions, each lasting about 1-2 hours. These sessions are guided by a neutral mediator who facilitates discussions and helps the parties find common ground. The goal is to reach mutually acceptable arrangements for children, finances and property division following separation.
Once an agreement is reached, the mediator can help draft a Memorandum of Understanding and, if children are involved, a Parenting Plan. These documents can be made legally binding through a consent order, providing a clear and enforceable resolution to the dispute.
